Unit Titles Act

The Unit Titles Act 2010 (UTA) is the legislation that governs properties subdivided into units, including The Ridge Resort Queenstown (The Ridge).

The Act enables multiple owners to hold individual or shared ownership of a unit, while collectively owning and sharing responsibility for common property such as driveways, lawns, and gardens.

The original Unit Titles Act was enacted in 1972 and underwent a significant overhaul in 2010, followed by several amendments in the early 2020s. It was initially designed to allow Land Information New Zealand (LINZ) to issue Records of Title (ROT) for apartments within multi-level buildings. In practice, it also enabled developers to create registerable titles for timeshare developments.

Ownership of a unit is freehold, meaning the owner holds a fee simple title. This ownership forms part of the owner’s estate and remains so until it is transferred to another party.
